By downloading the video content offered on the website, you (the “Broadcaster”) agree to accept the following Terms and Conditions:
§ 1 Usage Rights
RTV GmbH distributes all content on behalf of the mentioned companies. RTV GmbH and/or the respective company maintain the right to withdraw news2use and the contained video content, or refuse to provide service without the need for prior announcement or written justification. In case of the withdrawal of the website and/or the contained video content, RTV GmbH cannot be made liable for any damages whatsoever arising thereof.
Unless provided otherwise, Broadcaster is granted the non-exclusive, non-transferable and non-sub licensable right to use the video content offered on the website free of charge for world-wide television broadcasting, mobile phone TV and non-linear on-demand services. The video content may be used for an unlimited number of reruns and an unlimited period of time. In some cases the usage will be limited for a certain period of time. This will be clearly indicated. The Broadcaster is bound to these restrictions.
The Licence hereby warrants that the dubbing and/or sub-titling shall be a true and accurate translation of the scripts of the Programmes and that such translations shall not include any material that is defamatory of any person or organisation.
§ 2 Restrictions
The Broadcaster has to adhere to all rights and usage restrictions indicated in the present Terms and Conditions and in connection with the respective video content. In case of doubt, a written permission has to be obtained from RTV GmbH prior to broadcasting.
The Broadcaster may not convey, sell, sublicense, assign or transfer rights provided by the present Terms and Conditions. Independent re-distribution of the video content presented on the website or commercial use is prohibited. The editorial content may not be distorted and has always to be in the original context of the feature. In general the best way is to use the ready to air service. Sponsoring intros and outros may be used at the discretion of the broadcaster. Internet platforms may not publish footage and interviews without editing. Edited clips may be used.
In case of disregard of these before mentioned restrictions the Broadcaster is obliged to pay a penalty to RTV GmbH of € 20.000,00 for each case of disregard. Furthermore, disregard of the mentioned restrictions will be pursued in civil- as well as in criminal-law proceedings.
The music included in the video content is cleared for usage and protected by GEMA (German society for musical performing and mechanical reproduction rights). The Broadcaster is obliged to report the broadcasted music to the relevant local copyright collecting society in accordance with its local law and to pay all fees arising hereunder.
§ 3 Miscellaneous
RTV GmbH cannot be made liable for any non-compliances or damages with any laws, particularly if the Broadcaster places the video content in an illegal surrounding of contents. The Broadcaster is responsible for ensuring that the content does not violate broadcast restrictions nor national or regional laws.
The Broadcaster is obliged to report broadcast details (territory, broadcaster, coverage etc.) back to RTV GmbH on request.
§ 4 Applicable Law
The present Terms and Conditions will be governed in all respects by the laws of the Federal Republic of Germany, without reference to its laws relating to conflicts of law. The United Nations Convention on Contracts for the International Sale of Goods shall not apply. The exclusive place for jurisdiction for any lawsuits arising out of or relating to the present Terms and Conditions is Böblingen, Germany.
